Certain provisions of the European Regulation (EU) 2019/2088 known as Sustainable Finance Disclosure (SFDR) come into force on 10 March 2021.
SFDR aims to provide greater transparency on the degree of sustainability of financial products (incl. UCITs and AIFs) to effectively channel private investments towards sustainable investments, while preventing greenwashing.
The implementation of the Regulation will be spread over six main phases until 2023.
From 10 March 2021, asset managers will need to update their pre-contractual documents (fund prospectuses, KIIDs) and website with the classification of financial products in three categories, as laid out by Articles 6, 8 and 9 of the SFDR:
- Article 6: financial products that do not integrate any kind of sustainability into the investment process and could include stocks currently excluded by ESG products such as tobacco companies or thermal coal producers.
- Article 8: financial products that promote “among other characteristics, environmental or social characteristics, or a combination of those characteristics, provided that the companies in which the investments are made follow good governance practices.”
- Article 9: financial products that have defined and quantifiable ESG risk objectives, such as carbon emission reductions. An index must be designated as a reference benchmark.
